1. Purpose

These terms govern the use of the website embera.com (“Embera”, “the Website”, “the Platform”), operated by [YOUR FULL NAME], NIF [YOUR NIF], residing at [YOUR ADDRESS] (“the Operator”).

4. Nature of the website

Embera is an online directory that publishes advertisements for adult companions who offer their services in Portugal. Embera acts exclusively as an advertising platform and does not intervene, in any way, in any arrangements between advertisers and users.

Specifically, Embera does NOT:

  1. Organise, coordinate, or facilitate meetings between users and advertisers;
  2. Receive, process, or intermediate any payments between users and advertisers;
  3. Receive commissions, percentages, or any consideration on services provided by advertisers;
  4. Employ, manage, direct, or supervise advertisers;
  5. Provide physical premises for any services.

Advertisers are independent adult individuals who contract exclusively for advertising space on the Website, by means of a fixed monthly fee paid outside the Platform for the inclusion of their listing. This monthly fee is independent of any service the advertiser may provide to users of the Website.

5. Access and use conditions

Access to the Website is free and does not require registration or account creation by visiting users.

Inclusion of advertisements is subject to application, verification, and approval by the Operator, as described in Section 7.

Users undertake to use the contents and services appropriately and not to use them to:

  1. Distribute criminal, violent, non-consensual pornographic, racist, xenophobic, offensive, or terrorism-related content, or in general any content contrary to law or public order;
  2. Introduce computer viruses into the network or engage in actions that may alter, damage, interrupt, or cause errors in electronic documents, data, or systems of the Operator or third parties, or prevent access to the Website by other users through excessive resource consumption;
  3. Attempt to access restricted areas of the Operator's systems or unauthorised information;
  4. Violate intellectual or industrial property rights, or the confidentiality of information belonging to the Operator or third parties;
  5. Impersonate other users;
  6. Reproduce, copy, distribute, transform, or publicly communicate the contents of the Website without express authorisation from the rights holder;
  7. Collect data for advertising purposes or send unsolicited commercial communications;
  8. Use the Website for any unlawful purpose, including but not limited to the exploitation, trafficking, or coercion of any person.

All content on the Website (text, photographs, graphics, images, icons, technology, software, graphic design, and source code) is the property of the Operator or has been licensed for use on the Website. Users are granted no rights over such content beyond those strictly necessary for proper use of the Website.

6. Age restriction

The Website is intended exclusively for persons aged 18 or over. Access and use by minors is expressly prohibited. No minors will be admitted, even with parental consent or if legally emancipated.

Users under 18 must leave the Website immediately.

The Operator reserves the right to block and prevent the publication or viewing of content by anyone suspected of being a minor, and to require legal identification documents (Citizen Card, Passport, Driving Licence) for age verification.

All listings feature a reporting mechanism through which anyone may report suspicions regarding the age or consent of any advertiser. The Operator treats all reports with the utmost seriousness.

7. Application, verification, and publication of listings

Inclusion of a listing on Embera is subject to a manual application, verification, and approval process carried out by the Operator, which includes:

  1. Submission of the application form available on the Website;
  2. In-person or documentary verification of the applicant's identity and age, by means of a valid identification document (Citizen Card, Passport, or Driving Licence);
  3. Confirmation of the applicant's free and informed consent to publication of their listing;
  4. Agreement on the advertising monthly fee and its terms, established outside the Platform;
  5. Editorial review of the content submitted for publication (photographs, description, contact details).

The Operator reserves the right to reject any application, without the need to provide reasons, particularly where:

  1. The applicant is under 18 years of age;
  2. The documents presented are invalid, incomplete, do not match the applicant, or raise reasonable doubt;
  3. The applicant's identity or age cannot be confirmed with certainty;
  4. The information or data provided may indicate a false identity;
  5. The submitted content violates these Terms.

No listing will be published without the Operator's prior approval.

8. Unauthorised content

The following content will not be published and will be immediately removed:

  1. Persons under 18 years of age at the time the image was taken;
  2. Any form of sexual interaction without the free consent of all participants;
  3. Blood, mutilation, or violence of any kind;
  4. Bestiality;
  5. Visible consumption of drugs or excessive alcohol;
  6. Promotion or facilitation of human trafficking or sex trafficking;
  7. Content that violates the rights of third parties.

If evidence of criminal activity carried out through the Platform is detected or reported, the Operator will communicate the facts to the competent authorities, providing all necessary information through the applicable legal procedures.

9. Removal of listings and reports

Any advertiser may request removal of their listing at any time by contacting hello@embera.pt. Requests will be processed within 48 hours.

Any person who believes a listing violates their rights, contains false information, involves a minor or non-consenting person, or violates these Terms, must report it immediately at hello@embera.pt. The Operator will review the report and may remove the listing preventively while the review is conducted.

10. Disclaimer of warranties and liability

The content of the Website is for informational purposes only. The Operator does not guarantee the accuracy, completeness, validity, or timeliness of published listings, nor their suitability for any specific purpose.

To the fullest extent permitted by law, the Operator disclaims any liability for damages arising from:

  1. Inability to access the Website or inaccuracy of content;
  2. The presence of viruses or other elements that may cause damage to the User's systems or data;
  3. Non-compliance with the law or these Terms by any user or advertiser;
  4. Any interactions established between users and advertisers, which take place entirely outside the Platform and under the sole responsibility of the parties involved;
  5. Content of external websites linked to from Embera.

11. Intellectual and industrial property

The Operator holds all intellectual and industrial property rights in the Website and in the elements contained therein (images, sound, video, software, text, trademarks, logos, colour combinations, structure, design, and choice of materials).

The contents of the Website are works protected by Portuguese law, applicable European Union law, and international treaties to which Portugal is a party.

Under the Portuguese Code of Copyright and Related Rights, the reproduction, distribution, public communication, or making available, in whole or in part, of the contents of the Website for commercial purposes, in any medium and by any technical means, is prohibited without the express authorisation of the Operator.

Users may view the elements of the Website and, where applicable, print, copy, and store them for exclusively personal and private use.

12. Suspension and termination

The Operator reserves the right to remove listings and block access to advertisers or users in the following circumstances:

  1. Improper conduct or conduct contrary to these Terms;
  2. Submission or publication of unauthorised content as described in Section 8;
  3. Reasonable suspicion of false identity or age;
  4. Express request of the advertiser;
  5. Breach of agreed obligations, including failure to pay the advertising monthly fee.

13. Applicable law and jurisdiction

The relationship between the User and the Operator is governed by Portuguese law. Any dispute arising from these Terms or from use of the Website shall be submitted to the jurisdiction of the courts of [Lisbon / Porto / your jurisdiction], with express waiver of any other forum.

The Operator also reserves the right to pursue any civil or criminal actions it deems appropriate in the event of misuse of the Website or breach of these Terms.
